1. What Mercury Falling Is
Mercury Falling is a weather notification service. You configure the conditions you care about and the locations you care about, and we send you an email or a web push notification when public weather data indicates those conditions may occur.
2. Important Safety Notice: Please Read
Mercury Falling is an informational convenience, not an emergency notification system. Do not rely on it as your only source of severe weather information.
- We do not guarantee that any alert will be sent, delivered, or delivered in time to be useful.
- Email and push notifications depend on networks, devices, and providers outside our control. Messages can be delayed, filtered, or lost.
- Our alerts are derived from public weather data and may be incomplete, delayed, or inaccurate.
- Mercury Falling does not produce weather forecasts. We interpret publicly available forecast data to determine whether your configured conditions may occur.
You are responsible for monitoring weather conditions yourself whenever weather could affect your safety, property, travel, or other important activities.
For official warnings and life-safety decisions, use the National Weather Service (weather.gov), NOAA Weather Radio, local emergency management, and local broadcast media. Always follow instructions from emergency officials.
3. Eligibility
You must be at least 13 years old to use Mercury Falling and old enough to enter a binding contract in your jurisdiction. The service is intended for use in the United States.
4. Your Account
You are responsible for maintaining access to the email address associated with your account. It is how you sign in and how alerts reach you, so losing access to it means losing access to the service.
Mercury Falling has no passwords. You sign in with a passkey, a link emailed to you, or a six-digit code emailed to you. You are responsible for the security of the email account you sign up with and of any device holding a passkey, because either one is enough to access your account. Tell us promptly at [email protected] if you believe your account has been accessed without your permission.
5. What Is Public
Some parts of the service are deliberately readable by anyone holding a link, so that you can share them:
- Every alert has a public page at a short address. It shows the alert's generated name, its conditions, the city and state of its location, and the forecast readings that matched. It does not show your email address, your account, or the exact coordinates of your location. Anyone with the link can view it, and the link is not guessable.
- If you use the calendar feed, its address contains a long-lived token that grants access to your upcoming matching conditions. Treat it like a password: anyone you give it to, or any service you subscribe with, can read that feed. You can revoke it at any time from your profile, which stops every existing subscription.
6. Acceptable Use
Don't use the service to break the law, don't attempt to disrupt or gain unauthorized access to our systems, don't scrape or resell our alerts as your own service, and don't create accounts in bulk. We may suspend or terminate accounts for violations of these Terms or for activity that we reasonably believe threatens the security, reliability, or operation of the service.
7. Service Availability and Changes
We aim for reliable service but do not promise any specific uptime. We may modify, suspend, or discontinue features. We may also perform maintenance, impose usage limits, or remove functionality without notice.
We are not responsible for failures caused by events beyond our reasonable control, including internet outages, power failures, acts of nature, or failures of third-party providers.
8. Weather Data
Weather and air quality data are provided by Open-Meteo.com and are used under the Creative Commons Attribution 4.0 International licence. Open-Meteo aggregates forecasts from national weather services including NOAA, ECMWF, Deutscher Wetterdienst and others. We derive alert conditions from that data; the conditions we report are ours, not theirs.
Some pages also show observed radar, read from the National Oceanic and Atmospheric Administration's public reflectivity mosaic. Radar reports where precipitation is falling now rather than what is expected; it does not distinguish rain from snow, and any strength we describe from it is a relative reading rather than a measurement.
Mercury Falling is not endorsed by, affiliated with, or operated by Open-Meteo, NOAA, the National Weather Service, or any government agency.
9. Disclaimer of Warranties
The service is provided "as is" and "as available," without warranties of any kind, express or implied, including any implied warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement. Some jurisdictions do not allow certain warranty exclusions, so parts of this section may not apply to you.
10. Limitation of Liability
To the fullest extent permitted by law, 1235Media LLC and its officers, directors, employees, contractors, affiliates, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of property, business, data, or profits, arising from your use of or inability to use the service, including any failure to send or deliver an alert.
Our total liability for any claim relating to the service will not exceed the amount you paid us in the twelve months before the claim.
Some jurisdictions do not allow limits on liability for personal injury or for gross negligence or willful misconduct, and nothing here limits liability that cannot lawfully be limited.
11. Subscription and Billing
Mercury Falling is free for 30 days from the day you create your account. After that, alerts stop being checked unless you subscribe. Nothing you have set up is deleted: your locations, conditions and schedules stay exactly as they are, and subscribing starts them again.
Subscriptions are billed annually in advance and renew automatically until cancelled. About a week before each renewal we will email you the date it renews and the amount you will be charged, with a link to cancel. You can cancel at any time from your profile; cancelling stops the next renewal and your alerts continue until the end of the period you have paid for. We do not provide refunds for partial periods, except where required by law.
We may change the price of a subscription. If we do, we will email you at least 30 days before it applies to your renewal, and you may cancel before then.
Payments are processed by Stripe. We never see or store your card details. Stripe handles the card itself, and your payment information is subject to Stripe's privacy policy.
If a renewal payment fails, we and Stripe may email you and retry the payment for a period. If it does not succeed, the subscription ends and your alerts stop being checked.
12. Termination
You may cancel at any time from your profile. Cancelling stops the next renewal and your alerts continue to the end of the period you have paid for; nothing is deleted, and subscribing again picks everything up as it was. If you want your account and its data removed, email us and we will do it, as described in the Privacy Policy.
We may suspend or terminate your access at any time, including for violations of these Terms, suspected abuse, or to protect the service or other users.
13. Ownership
Mercury Falling, including its software, design, logos, text, and original content, is owned by 1235Media LLC and protected by applicable intellectual property laws. These Terms do not grant you any ownership rights in the service.
14. Changes to These Terms
We may update these terms. For material changes, we will email you at least 30 days before they take effect. Continuing to use the service after that means you accept the updated terms.
15. Governing Law
These terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to conflict-of-law rules. Disputes will be brought in the state or federal courts located in Philadelphia, Pennsylvania.
16. Entire Agreement
Your use of Mercury Falling is also governed by our Privacy Policy, which forms part of these Terms.
These Terms constitute the entire agreement between you and 1235Media LLC regarding Mercury Falling and supersede any prior agreements or understandings relating to the service.
